Draft CAM — End-User License Agreement (EULA), Terms of Service & Privacy Policy
THIS END-USER LICENSE AGREEMENT (“AGREEMENT”) IS A BINDING LEGAL CONTRACT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE LEGAL ENTITY, “YOU” OR “LICENSEE”) AND DRAFT CAM CNC LLC. BY DOWNLOADING, INSTALLING, ACTIVATING, COPYING, OR OTHERWISE USING THE SOFTWARE, OR BY CLICKING “I ACCEPT” DURING INSTALLATION, YOU AGREE TO BE BOUND BY ALL TERMS OF THIS AGREEMENT, INCLUDING THE CNC MACHINE SAFETY AND ASSUMPTION OF RISK PROVISIONS IN SECTION 5, THE AI AND AUTOMATION DISCLAIMERS IN SECTION 6, THE WARRANTY DISCLAIMERS IN SECTION 9, THE LIMITATION OF LIABILITY IN SECTION 10, AND THE DISPUTE RESOLUTION AND CLASS ACTION WAIVER IN SECTION 14. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.
1. Grant of License and License Tiers
1.1 License Grant. Subject to your continuous compliance with this Agreement and payment of applicable license fees, Draft CAM CNC LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the executable object-code version of the Software solely for your internal design, drafting, and CNC manufacturing operations in accordance with the tier you have licensed:
- (a) 30-Day Evaluation Trial (“Trial License”): Permits temporary evaluation of the Software for up to thirty (30) calendar days from initial activation on a single computer. Trial Licenses may enforce feature, export, or AI usage limits (the “Trial AI Sampler”). You may not circumvent or reset the trial timer by modifying system clocks, registry keys, or application data files.
- (b) Draft CAM Hobby (“Hobby License”): Licensed to a single named individual or small hobby shop for use on up to two (2) computers owned or controlled by Licensee (for example, one office desktop/laptop and one shop-floor CNC controller PC), provided only one instance is actively used at a time. Certain commercial production features (including multi-part project containers, 3D STEP/IGES assembly import, sheet-metal K-factor bend unfolding, remnant inventory tracking, and multi-sheet batch nesting) are reserved for the Shop tier.
- (c) Draft CAM Shop (“Shop License”): Licensed to an individual or commercial fabrication business for use on up to two (2) computers per purchased seat owned or controlled by Licensee, unlocking the full commercial feature set of the Software.
1.2 Perpetual Offline Use and Annual Maintenance Window.
-
(a) Perpetual Desktop Core: Upon purchase of a Hobby License or Shop License and activation via a cryptographic license key (
DCAM1format), your right to run the core offline desktop Software version installed during your active maintenance period is perpetual, subject to compliance with this Agreement. -
(b) Maintenance and Updates (
updates_until): Each new Hobby License or Shop License includes one (1) year of software updates, new releases, and access to optional cloud-assisted AI features from the date of purchase. After the initial one-year period, you may optionally renew annual maintenance at the then-current renewal rate. If you elect not to renew maintenance, your offline desktop Software will continue to operate indefinitely on the last version released prior to your maintenance expiration date, while access to subsequent software updates and cloud-hosted AI proxy services will pause until maintenance is renewed.
2. License Restrictions and Anti-Piracy
You shall not, and shall not permit any third party to:
- Share, publish, sell, lease, sublicense, or distribute your
DCAM1cryptographic license key to any third party, or run the Software on more computers than permitted by your License Tier; - Reverse-engineer, decompile, disassemble, or attempt to derive the source code, geometric algorithms, nesting engines, cryptographic signing keys (
Ed25519), or bundled machine-learning weights (.onnxmodels) of the Software, except to the minimum extent expressly permitted by applicable law notwithstanding this restriction; - Modify, tamper with, bypass, or disable any license verification mechanism (
license.json), tier gate, trial expiration check, or cloud proxy quota control; - Use the Software or its output to train competing machine-learning models or to build a competing CAD, CAM, or nesting software product; or
- Remove, obscure, or alter any copyright, trademark, or safety notices embedded in the Software or its user interface.
3. Optional Cloud AI Features and Annual Token Allowance
3.1 Local vs. Cloud Features. All core 2D CAD drafting, geometric snapping, constraints, DXF import/export, standard photo contour tracing, local neural background removal, 3D STEP/IGES unfolding, true-shape nesting, toolpath generation, and G-code post-processing execute locally on your computer and do not require an internet connection or ongoing subscription.
3.2 Cloud AI Proxy Services and Fair-Use Allowance (Internet Connection Required). Active maintenance holders (and eligible Trial Sampler users) may optionally enable cloud-assisted artificial intelligence features (including AI Plasma Stencil and Sign Generation, AI Post-Processor and Cut-Chart Extraction, and the “Help Me” AI Support Utility) routed through Draft CAM CNC LLC’s managed proxy servers. An active internet connection is required to use cloud AI features.
- (a) Annual AI Allowance: Each active 1-year maintenance term includes a preset annual computational allowance (tracked via the in-app AI Allowance fuel gauge from 100% to 0%).
- (b) Exhaustion and Offline Mode: The AI Allowance has no cash value, is non-refundable, and resets upon annual maintenance renewal. If your annual AI Allowance reaches 0%, or if you enable Offline Mode in the Software, all local CAD, CAM, tracing, unfolding, nesting, and G-code export tools continue to function without interruption.
- (c) Third-Party AI Providers: Cloud AI requests are processed using third-party large language and vision models (such as Google Gemini APIs). Draft CAM CNC LLC does not guarantee the uninterrupted availability of third-party cloud APIs.
4. Ownership and Intellectual Property
4.1 Software Ownership. The Software is licensed, not sold. Draft CAM CNC LLC retains all right, title, and interest, including all copyrights, trade secrets, trademarks (“Draft CAM,” “Draft CAM CNC,” and the hexagon wireframe “D” emblem), and other intellectual property rights in and to the Software and documentation.
4.2 Your Designs and G-Code Output. You retain all ownership and intellectual property rights in the 2D drawings, .dcc and .dcp project files, .dxf files, and .tap/.nc/.ngc G-code programs you create using the Software. You are solely responsible for ensuring that any logos, photographs, artwork, or 3D CAD assemblies you import or trace do not infringe the copyrights, trademarks, or intellectual property rights of any third party.
5. Critical CNC Machine Safety, G-Code Verification, and Assumption of Risk
PLEASE READ THIS SECTION CAREFULLY. COMPUTER NUMERICAL CONTROL (CNC) PLASMA TABLES, LASER CUTTERS, ROUTERS, WATERJETS, AND PRESS BRAKES ARE INHERENTLY DANGEROUS INDUSTRIAL MACHINES CAPABLE OF CAUSING DEATH, SEVERE PERSONAL INJURY, BLINDNESS, TOXIC FUME INHALATION, FIRE, EXPLOSION, AND CATASTROPHIC PROPERTY DAMAGE.
5.1 Software Output Is an Unverified Aid Only. The Software generates toolpaths, kerf offsets, lead-ins, lead-outs, pierce delays, feed rates, small-hole slowdowns, corner slowdowns, Torch Height Controller (THC) lock/unlock commands (such as M62/M63, M666/M667, H0/H1), and numerical control code (.tap, .nc, .ngc, or other dialects, collectively “Machine Code”) based on mathematical approximations and user-supplied parameters. DRAFT CAM CNC LLC DOES NOT KNOW AND CANNOT CONTROL THE PHYSICAL CONFIGURATION, WIRING, FIRMWARE, LIMIT SWITCHES, TORCH HEIGHT CONTROLLER, MATERIAL CLAMPING, OR CONDITION OF YOUR SPECIFIC CNC MACHINE.
5.2 Mandatory Operator Verification and Torch-Off / Beam-Off Dry Run. Before executing any Machine Code generated by the Software with an active plasma arc, laser beam, or rotating spindle, YOU MUST:
- Inspect Every Line of Machine Code: Visually and manually review the generated G-code headers, footers, units (
G20inches vs.G21millimeters), work-coordinate offsets (G54–G59,G90/G91), torch/laser fire and extinguish commands (M3/M5), and THC commands against your machine controller’s official manual; - Simulate in the Dry Run Panel and Controller Preview: Verify cut order, rapid traverses (
G0), inside-out hole sequencing, and lead-in clearances; - Perform a Physical Torch-Off / Beam-Off Air Cut: Run the complete program on your CNC machine with the plasma power supply, laser source, or spindle DISABLED / TURNED OFF and at reduced rapid override speed to verify that the gantry stays within table travel limits and does not collide with clamps, slats, water pans, or tipped-up drop-out parts; and
- Verify Unverified Post-Processors: Any custom, learned, or AI-drafted Machine Profile or Post-Processor is marked UNVERIFIED by default. By checking the verification acknowledgment in the Software, you accept sole responsibility for testing and validating that dialect on your hardware.
5.3 Never Operate Unattended; Fire and Fume Hazards. Plasma cutting and laser cutting generate extreme heat, molten slag, sparks, ultraviolet/infrared radiation, and hazardous metal fumes (including hexavalent chromium on stainless steel and zinc oxide fumes on galvanized steel). You agree NEVER to run a CNC machine unattended, to maintain proper ventilation, eye/hearing protection, and fire suppression equipment at all times, and never to cut pressurized vessels, PVC/chlorinated plastics (which release lethal chlorine gas under a laser), or explosive materials.
5.4 Sheet-Metal Unfolding, K-Factor, and Photo Depth (Z) Estimates. Any 2D flat pattern produced by the Software’s 3D STEP/IGES Sheet-Metal Unfolder (K-factor bend allowance calculation) or the Formed-Part Photo Depth (Z) Unfolder is a mathematical estimate only. Actual bend elongation varies by material grain direction, alloy batch, press-brake die V-opening, punch radius, and camera lens distortion. You must always cut and bend a physical test coupon and verify dimensional tolerances before cutting production material or structural components.
5.5 Express Assumption of Risk. You expressly assume all physical, mechanical, electrical, fire, and financial risks associated with operating CNC machinery and fabricating parts using files or Machine Code generated by the Software.
6. Artificial Intelligence (AI) and Automated Cut-Chart Disclaimers
6.1 AI Outputs May Contain Errors (“Hallucinations”). The Software includes optional AI-assisted utilities (including Draft with AI for post-processors, Import Cut Chart from Photo / PDF (AI), AI Plasma Stencil & Sign Generator, and the Ask Draft CAM AI support assistant). Generative AI models are probabilistic and can misread characters, transpose decimal points, invent invalid M-codes, misidentify controller dialects, or recommend unsafe feed rates, pierce heights, or amperages.
6.2 No Substitution for Manufacturer Cut Charts. Cut tables extracted from photographs or PDFs via AI, or seeded in built-in presets, are provided strictly for convenience. You must manually cross-check every kerf width, feed rate, pierce delay, pierce height, cut height, and arc voltage against the official printed operating manual published by your plasma cutter, laser source, or CNC table manufacturer.
7. No Engineering Certification; Structural Part Disclaimer
The Software is a geometric drafting and CAM tool, not a licensed structural engineering or finite-element analysis (FEA) package. Built-in parametric shape generators (including Baseplates, Bolt Flanges, Gussets, and Brackets), stencil bridges/tabs, and Check Drawing diagnostics (THIN_WEB, DROPOUT_ISLAND, OPEN_PROFILE) check only for 2D geometric cuttability—they do not calculate structural load capacity, weld shear, bolt tear-out, fatigue life, or building/highway code compliance. You are solely responsible for having a licensed Professional Engineer (P.E.) review and stamp any part intended for structural, load-bearing, automotive, trailer, rigging, lifting, aerospace, medical, or life-safety applications.
8. Privacy and Data Collection Policy
8.1 Local-First Architecture. By default, your CAD drawings (.dcc, .dcp, .dxf), machine profiles (machines.json), K-factor tables (kfactors.json), and remnant inventory (inventory.json) are stored locally on your computer (%APPDATA%\Draft CAM CNC\Draft CAM 2D). Draft CAM CNC LLC does not upload or harvest your proprietary CAD drawings or G-code files during normal drafting and CAM operation.
8.2 Data Transmitted When Using Optional Cloud AI Features. Only when you explicitly invoke an online AI feature (and Offline Mode is unchecked) does the Software transmit the minimum data required to fulfill that specific request to our proxy server and third-party AI provider (Google Gemini API):
- (a) AI Stencil Generator: Sends your text prompt or reference image to generate a silhouette image.
- (b) AI Post-Processor / Cut-Chart Builder: Sends the sample G-code text, controller description, or cut-chart photo you select for extraction.
- (c) AI Support Assistant (“Help Me”): Sends your typed question and a read-only diagnostic summary (entity counts, layer names, bounding-box span, and error codes)—never your proprietary vertex coordinates or part geometry.
- (d) Quota and License Verification: Sends your
DCAM1license key (or hashed machine identifier and email for the 30-Day Trial AI Sampler) to verify your maintenance date and update your micro-dollar quota ledger.
8.3 Payment Processing. Online purchases are processed by our third-party Merchant of Record / payment processor (such as Lemon Squeezy or Stripe). Draft CAM CNC LLC does not store your full credit card number on its servers.
9. Disclaimer of Warranties (“AS-IS”)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE, DOCUMENTATION, POST-PROCESSORS, MACHINE PRESETS, CUT CHARTS, AND AI SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
DRAFT CAM CNC LLC AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OF GEOMETRY OR DIMENSIONS, OR SAFETY OF GENERATED G-CODE. DRAFT CAM CNC LLC DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, THAT TOOLPATHS WILL BE FREE OF GOUGES OR COLLISIONS, OR THAT DEFECTS WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY DRAFT CAM CNC LLC OR ITS AI ASSISTANT SHALL CREATE A WARRANTY.
10. Limitation of Liability
10.1 Exclusion of Consequential and Shop Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRAFT CAM CNC LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR:
- (a) PERSONAL INJURY, BODILY HARM, OR DEATH;
- (b) DAMAGE TO CNC TABLES, GANTRIES, TORCHES, LASER HEADS, CONSUMABLES, PRESS BRAKES, OR SHOP EQUIPMENT;
- (c) SCRAPPED, RUINED, OR MISCUT METAL PLATE, SHEET STOCK, OR RAW MATERIALS;
- (d) DEFECTIVE OR OUT-OF-TOLERANCE FABRICATED PARTS;
- (e) LOST PROFITS, LOST SHOP PRODUCTION TIME, BUSINESS INTERRUPTION, OR LOSS OF DATA;
ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SOFTWARE OR ANY GENERATED G-CODE OR DRAWINGS, EVEN IF DRAFT CAM CNC LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT PRODUCT LIABILITY, OR OTHERWISE).
10.2 Strict Cap on Total Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRAFT CAM CNC LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE SHALL NOT EXCEED THE ACTUAL LICENSE FEES PAID BY YOU TO DRAFT CAM CNC LLC FOR THE SOFTWARE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR TEN U.S. DOLLARS ($10.00) IF YOU ARE USING A FREE TRIAL LICENSE).
10.3 Essential Basis of the Bargain. You acknowledge that Draft CAM CNC LLC has set its license prices and entered into this Agreement in reliance upon the disclaimers of warranty and the limitations of liability set forth herein, that the same reflect an agreed allocation of risk between the parties (given that a single sheet of steel or CNC machine crash can exceed the price of the Software many times over), and that they form an essential basis of the bargain between you and Draft CAM CNC LLC.
11. Indemnification
You agree to indemnify, defend, and hold harmless Draft CAM CNC LLC and its members, managers, officers, employees, and agents from and against any and all third-party claims, lawsuits, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your operation of any CNC machine, plasma cutter, laser cutter, or shop equipment;
- Any physical part, bracket, sign, structure, or product designed, unfolded, nested, or cut by you using the Software and sold, installed, or supplied to any customer or third party (including any product liability, structural failure, or personal injury claim);
- Any allegation that artwork, logos, images, or 3D files imported or traced by you infringe a third party’s intellectual property rights; or
- Your breach of this Agreement or violation of any applicable law or safety regulation.
12. Refund Policy
Because the Software provides a 30-Day Evaluation Trial allowing you to test compatibility with your computer and CNC controller prior to purchase, and because DCAM1 license keys are offline cryptographic signatures that cannot be remotely revoked once issued, all sales of perpetual license keys (Draft CAM Hobby and Draft CAM Shop) and maintenance renewals are final and non-refundable once the DCAM1 license key has been delivered, except where required by mandatory consumer protection law or at the sole discretion of Draft CAM CNC LLC within fourteen (14) days of purchase if the license key has never been activated.
13. Open-Source and Third-Party Notices
The Software bundles certain unmodified open-source libraries under permissive and LGPL licenses (including PySide6 / Qt under LGPLv3, OpenCASCADE Technology via cadquery-ocp-novtk under LGPL-2.1 / Apache-2.0, Shapely under BSD, NumPy under BSD, ezdxf under MIT, OpenCV under Apache-2.0, and ONNX Runtime under MIT). Those libraries remain the property of their respective copyright holders and are licensed under their respective open-source licenses included in the Software’s _internal installation directory.
14. Governing Law, Exclusive Venue, and Class Action Waiver
14.1 Governing Law. This Agreement and any dispute arising out of or relating to the Software shall be governed by and construed in accordance with the laws of the State of Minnesota, United States of America, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
14.2 Exclusive Jurisdiction and Venue. Any legal suit, action, or proceeding arising out of or related to this Agreement or the Software shall be instituted exclusively in the state courts of the State of Minnesota located in Lake County or St. Louis County, Minnesota, or the United States District Court for the District of Minnesota (Duluth Division). You irrevocably waive any objection to the laying of venue or personal jurisdiction in such courts.
14.3 Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, ANY PROCEEDING TO RESOLVE OR LITIGATE ANY DISPUTE IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR DRAFT CAM CNC LLC WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION.
14.4 One-Year Limitation on Claims. Any cause of action or claim you may have arising out of or relating to this Agreement or the Software must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
15. Export Control and U.S. Government Restricted Rights
You may not use, export, or re-export the Software in violation of United States export laws and regulations, including to any country subject to a U.S. trade embargo or to any person on the U.S. Treasury Department’s list of Specially Designated Nationals.
16. Entire Agreement, Severability, and Contact Information
16.1 Entire Agreement. This Agreement constitutes the entire agreement between you and Draft CAM CNC LLC regarding the Software and supersedes all prior or contemporaneous understandings, communications, or representations.
16.2 Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions of this Agreement shall remain in full force and effect.
16.3 Contact Information. Questions or legal notices regarding this Agreement should be directed to:
